Delegates Doyle and Tabb move to amend the Judiciary Committee
amendment by striking the amendment in its entirety and inserting
in lieu thereof the following:
"On page 20, section 13b, line 168, by striking all of
subdivision (1) in its entirety and inserting in lieu thereof the
following:
"(1) (A) Each pari-mutuel thoroughbred horse track shall
provide at least one restricted race per racing day: Provided,
That sufficient horses and funds are available.
(B) Each pari-mutuel thoroughbred horse track that, after
April 10, 2009, provides restricted races that were, in the
aggregate, at least ninety percent full on the average over a
period of six consecutive months shall thereafter provide at least
two restricted races per racing day: Provided, That sufficient
horses and funds are available. A track that provides two
restricted races per day that are, in the aggregate, on the average
less than sixty-seven percent full over a period of six consecutive
months, is thereafter no longer required to provide two restricted
races per day until it again meets the requirements to provide two
restricted races per day pursuant to this subdivision.
(C) Each pari-mutuel thoroughbred horse track that is
providing two restricted races per day that, in the aggregate,
average at least ninety percent full for six consecutive months after the reenactment of this section by Act of the 2009 Regular
Session of the Legislature shall thereafter provide at least three
restricted races per racing day: Provided, That sufficient horses
and funds are available. A track that provides three restricted
races per day as required by this subsection that in the aggregate
average less than sixty-seven percent full over a period of six
consecutive months, is thereafter no longer required to provide
three restricted races per day until it again meets the
requirements to provide three restricted races per day pursuant to
this subdivision. For purposes of this subsection, there are
sufficient horses if there are at least seven single betting
interests received for the race: Provided further, That if
sufficient horses and funds are available, any thoroughbred horse
racetrack whose licensee participated in the Thoroughbred
Development Fund for at least four consecutive calendar years prior
to December 31, 1992, shall provide two restricted races per racing
day, at least one of which may be split at the discretion of the
racing secretary. The restricted race races required by this
section must be included in the first nine races written in the
condition book for that racing day."
